Terms  and Conditions of Use

Please read these conditions carefully. They will form an important part of any contract between Elizabeth Plant and you.  By using this website you agree that the information provided is non-medical and for information purposes only and is not intended to replace medical or other professional advice.  By applying for therapies or health coaching with me you agree to be bound by these terms, which by proceeding, you confirm you have read and understood. All of my work and services are conducted under the jurisdiction of UK law.   

 

General Disclaimer

The content of my website and the products and services offered by me comply with appropriate UK legislation and regulation. Please note I am a massage/complementary therapist and  holistic Integrative Nutrition health coach and complementary therapist.  I am not medically qualified and I am therefore unable to diagnose medical conditions, nor am I able to offer medical advice. My therapy and health coaching services and my programmes are not intended to replace medical advice nor medical treatment, including that of a doctor or a registered dietician, nor do I or my therapies and services claim to “cure”, "prevent" nor "heal" medical conditions. The Health Coaching/therapy contract with Elizabeth Plant shall be subject to the law of England and Wales and to the exclusive jurisdiction of the English courts. If you have a medical condition and/or are taking medication then it is important to talk about any lifestyle or dietary changes you make with your medical doctor or other primary healthcare provider. Data Protection, General Data Protection Regulation and Privacy Statement

 

GDPR is bringing in new legal protection for personal information from May 2018. This tells you what personal information I gather via my website,  and why, and what your rights are.

What information I hold and what do I do with it:

As a professional therapist and coach I need to keep accurate records on my clients in order to give professional treatments.  Elizabeth Plant will hold and process any personal data you submit in the course of applying for health coaching or other therapy services and products.  I keep paper records which are held securely and only accessible by myself.  

What information I hold and what I do with it

 

The information to be held is:

  •  Your contact details pertaining to appointments such as your name, email and phone, address 

  • Medical history and other health-related information (which I will take from you at first consultation)

  • Treatment details, appointment times and associated notes (which I will take after each consultation)

  • Emergency contact details  

  • lifestyle overview

I will NOT share your information with anyone else (other than within my own practice, or as required for legal process) without explaining why it is necessary, and getting your explicit consent.

The Purpose of Client Data processing:
In order to give professional treatments, I will need to gather and retain potentially sensitive information about your health. I will only use this information for informing the treatments I provide, to ensure I can treat you safely and for any associated recommendations or aftercare related to your health and wellbeing which I may offer. 

I will contact you using the contact preferences you give me in relation to: 

  • Appointment times                                                                                        

  • Reflexology/massage therapy/complementary therapy/coaching information or information related to your health    

  • Special offers and promotions  (you may unsubscribe from this at any time)

Data is held for 10 years in compliance with my insurance or if for a child then 10 years after the child’s 18th birthday.  I dispose of data safely.  I do not hold financial information.

You have the right to access personal information I hold and this will be provided within 30 days of your written request by email or text.  Information I hold on paper will be provided as photocopies and you may ask me to correct or remove information you think is inaccurate. Elizabeth Plant will be acting under the Data Protection Act 1998 ("DPA") and General Data Protection Regulation (“GDPR”) in relation to such personal data and am committed to complying with my legal obligations under these. I use your personal data for the purposes of arranging the provision of complementary therapies and health coaching to you to ensure they are safe and suitable, dealing with appointment renewals and to improve my understanding of your interests in my products and services.  I will also use your personal data to contact you, by post, telephone or Zoom and email for the duration of the health coaching/therapy program and after if you wish to remain in contact (in agreement with you - you will be able to select and opt in to which methods I use to contact you for appointments and my products and services  - please note all subscribers to my email list may unsubscribe at any time and I use a mail service compliant with legislation). Exceptions are when I work for certain venues who retain their own client data - for details please contact the venue for their Data Protection Policy.

Please note that I will NOT share your information with anyone else (other than as required for legal process and purposes) without explaining why it is necessary, and getting your explicit consent to do so.  Note: If I am contacted by a Covid19 Contact Tracer, for the purposes of identifying clients who have attended my clinic,  then I am bound to provide these contact details. 

Your Rights

    To know how your information will be held and used (this notice).

  • The right of access:
    To see your therapist’s records of your personal information, so you know what is held about you and can verify it.

  • The right to rectification:
    To tell your therapist to make changes to your personal information if it is incorrect or incomplete.

  • The right to erasure (also called “the right to be forgotten”):
    For you to request your therapist to erase any information they hold about you

  • The right to restrict processing of personal data:.
    You have the right to request limits on how your therapist uses your personal information

  • The right to data portability: under certain circumstances you can request a copy of personal information held electronically so you can reuse it in other systems.

  • The right to object:
    To be able to tell your therapist you don’t want them to use certain parts of your information, or only to use it for certain purposes.

  • Rights in relation to automated decision-making and profiling.

  • The right to lodge a complaint with the Information Commissioner’s Office:
    To be able to complain to the ICO if you feel your details are not correct, if they are not being used in a way that you have given permission for, or if they are being stored when they don’t have to be.

Therapists Rights on information:
Please note:
If you don’t agree to your therapist/coach keeping records of information about you and your treatments, or if you will not allow me to use the information in the way I need to for treatments, then I will not be able to treat you.

I need to retain your records of treatment for a certain period as described above, which may mean that even if you ask me to erase any details about you, I may have to keep these details until after that period has passed.

I may also need to move records between IT systems that are GDPR compliant.

If you become a client either through purchase of my coaching services and/or detox program please note that all materials are copyrighted and remain the property of their respective owners.  You may not, share, distribute or re-sell them in any form or way.

Informed Consent for Hands on Therapies

At all times when I am giving hands on treatment I aim to respect informed consent.  I will ask you beforehand if treatment is all right to go ahead. If at any time you wish me to stop you may ask me to do so and I want my clients to feel that they are in a safe environment.

Gift Vouchers

Voucher duration. Vouchers are valid for a period of 3 months from the date of purchase. Cannot be redeemed after expiry date.

Use of multiple vouchers. Only one gift voucher can be used per booking.

Use of promotional codes. Promotional codes cannot be used in conjunction with gift vouchers.

Email vouchers. Email vouchers shall be provided free of charge to the email address provided at point of purchase.

Postal vouchers. There are additional costs associated with provision of a postal voucher. Such costs are added to the voucher cost and shall be paid at the point of purchase. Please allow up to 7 days for delivery of a postal gift voucher.

Voucher redemption. Services must be pre-booked. Vouchers can be redeemed by phone or in person only. There is no option for online or email redemption. Redemption contact details are provided on the voucher.

Refunds. Vouchers are non-refundable other than within the 14 day cancellation period as per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. No change or credit given in the event that the voucher value exceeds the total cost of the therapy or coaching session – for example where a £100 voucher is used to purchase a £95 treatment.

Monetary vouchers. Monetary vouchers can be used for part or full payment of a treatment or coaching session only. If the cost exceeds the amount of the gift voucher, the balance must be paid in full by credit or debit card at the point of booking.

Treatment vouchers can only be redeemed against the specific treatment type for which they were purchased.

Transfer. Vouchers are non-transferable and cannot be exchanged for cash.

Lost or stolen vouchers. Lost, stolen or destroyed gift vouchers will not be exchanged or refunded.

Cancellation. In the unlikely event that an appointment needs to be cancelled by Elizabeth Plant, the gift voucher shall be reissued and shall be valid for a further month. In the event that an appointment is cancelled by a voucher holder or the holder does a no show no refund shall be given (except at Elizabeth Plant's discretion if for example the cancellation was due to an emergency or illness).

Coupon codes.  These are as outlined under gift vouchers for terms and conditions and cannot be exchanged for money nor can they be refunded.  Coupon codes are only valid for limited duration for example they may be an offer for a specific month.
